Our experience with Sarah Derbish of Coldwell Banker was profoundly unsatisfactory and raises significant concerns regarding fiduciary responsibility, professional competency, and ethical standards. At no point during the transaction did Sarah advocate for our interests or engage in true negotiation on our behalf. Rather, all terms were dictated to us by the buying agents, and Sarah consistently failed to provide counteroffers, strategies, or advocacy that would protect our position as sellers. In one instance, we lost weeks of valuable listing time because Sarah allowed a buyer to leverage inspection findings as a negotiation tool in what was explicitly represented to us as an “as-is” cash sale—an outcome that directly contradicted her prior assurances and resulted in material harm to us as clients. These and other actions misled us at critical points in the process, left us financially disadvantaged, and broke the trust that should exist between an agent and client. Sarah’s handling of documentation was riddled with errors that required repeated corrections and reissuance of documents for signature, further eroding confidence in her professional competence. These deficiencies represent not only poor communication but also a clear breach of fiduciary duty, misrepresentation of material facts, and a disregard for the ethical obligations owed to clients.
